These Terms of Service ("Terms") govern your access to and use of The Tarot Pen, a subscription software tool for tarot readers ("the Service"), operated by The Tarot Pen ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Entertainment Purposes Only
The Tarot Pen is provided strictly for entertainment, creative, and personal reflection purposes. Tarot readings, AI-generated interpretations, and any content produced through the Service are not a substitute for professional advice of any kind — including but not limited to medical, legal, financial, psychological, or mental health advice. Nothing generated through the Service should be relied upon as fact, prediction, or professional guidance. You are solely responsible for any decisions you make based on content from the Service.
2. Who Can Use the Service
You must be at least 18 years old to create an account and use the Service. By registering, you confirm that you meet this requirement.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.
4. Subscriptions & Billing
- The Service is offered on a recurring subscription basis (monthly), with plans as described on our pricing page.
- Where offered, free trial periods convert automatically into a paid subscription unless cancelled before the trial ends.
- Subscriptions renew automatically each billing cycle until cancelled by you.
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access until that date.
- Payments are processed by our third-party payment provider. We do not store your full payment card details.
5. No Refunds
All payments are for digital products and services delivered immediately upon subscription activation. As such, all sales are final and non-refundable, except where required by applicable law. This applies to monthly subscription charges, renewals, and any add-on features. You may cancel at any time to prevent future charges, but no refund will be issued for the current or any prior billing period.
6. Acceptable Use
You agree not to: use the Service for any unlawful purpose; attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems; resell, sublicense, or redistribute access to the Service without our written permission; or use the Service to harass, deceive, or harm another person.
7. AI-Generated Content
The Service uses artificial intelligence to generate interpretations, phrasing suggestions, and related content. AI-generated content may occasionally be inaccurate, repetitive, or unsuitable for a given context. You are responsible for reviewing and using judgment before relying on or sharing any AI-generated output, including with your own clients.
8. Photo & Voice Features
Where the Service allows photo uploads (e.g. for spread interpretation) or voice interaction, you are responsible for ensuring you have the right to submit any images or audio you provide, and for obtaining any necessary consent from clients whose spreads or information you submit on their behalf.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. We do not guarantee the Service will be uninterrupted, error-free, or secure at all times.
10. Limitation of Liability
To the fullest extent permitted by law, The Tarot Pen and its operator shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of, or inability to use, the Service — including any decisions made based on tarot readings, AI-generated interpretations, or other content produced through the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.
11. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your subscription at any time.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.
